TERMS AND CONDITIONS OF SALE
1. OBJECT
The Terms and Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, any person browsing the site www.liquids-parfums.com/shop, (hereinafter referred to as the ‘consumer’ or ‘customer’) and on the other hand Différentes Latitudes, a limited liability company with capital of 105334.00 euros, registered in the Paris Trade and Companies Register under number 484033865, whose registered office is located at 5 rue du Commandant Lamy, 75011 Paris, France, and which is the owner of this site. They apply, without restriction or reservation, to all sales of products offered by Différentes Latitudes on its site www.liquids-parfums.com/shop. Consequently, ordering a product offered for sale on the Différentes Latitudes website constitutes full and complete acceptance of these terms and conditions of sale, which the consumer acknowledges having read prior to his or her order. These terms and conditions of sale apply to the exclusion of all other conditions. The consumer is informed that they may be updated at any time. The consumer must therefore consult this page regularly in order to stay informed of any changes made to the said terms and conditions of sale.
2. PRODUCTS
The products offered for sale are those described on our website, subject to availability. Stocks are regularly updated. However, an inventory error does not incur the liability of Liquides Parfums and in this respect Liquides Parfums shall not be held liable for the cancellation of an order for a product due to it being out of stock. The product visuals shown on our site are not contractual. They are provided for illustrative purposes and may differ slightly from the products received. We strive to provide the most accurate description possible in order that the customer information provided is as accurate as possible.
3. PRICE
The prices of all our products are given in euros and include VAT (VAT applicable on the day of the order). Any change in the legal VAT rates will be passed on in the price of the products, on the date stipulated by the relevant implementing decree.
Prices are subject to change at any time. Changes will not affect orders already confirmed with a shipping confirmation. Please note that the prices of our products do not include delivery or customs duties and other taxes, which you must pay directly to the carrier.
Our site contains a large number of products and if, despite our efforts, an incorrect price is given for a product and is part of your order, we will inform you of this error. We will suggest that you either continue the purchase at the correct price or cancel your order. If we are unable to contact you using the details provided at the time of your order, your order will be cancelled and you will be notified in writing.
4. USE OF OUR WEBSITE

5. USE AND PROTECTION OF YOUR PERSONAL DATA
The consumer is informed and accepts that his/her personal data may be collected when it is communicated on the website www.liquids-fragrances.com/shop when purchasing or creating an account and that this data may be processed electronically or manually.
The data is collected for the following purposes only: order management, customer relations, after-sales service, communication (on the latest news about Liquides Parfums following subscription to the newsletter), marketing, with the aim of offering a better customer experience on our site and a relevant offering and compliance with legal and regulatory obligations. The data is stored only for the period strictly necessary for the purposes stated above. This data is exclusively reserved for Liquides Parfums.
Différentes Latitudes acts as data controller within the meaning of Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of data (GDPR). Différentes Latitudes is committed to protecting and ensuring the security and confidentiality of its customers’ personal data in accordance with the GDPR, in particular by taking all necessary precautions to prevent this data from being damaged/distorted or from being accessed by unauthorised third parties.
In accordance with Articles 38 et seq. of the French Data Protection Act of 6 January 1978, as amended, and Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of data (GDPR), the customer has a right to access, correct and oppose personal data concerning him/her (Data Protection Rights). These rights may be exercised by simple request to Différentes Latitudes by letter sent to 5 rue du Commandant Lamy, 75011 Paris or by email via alina@differenteslatitudes.com, providing proof of your identity and a legitimate reason as provided for by law. Responses to requests made on the basis of one or more Data Protection Rights shall be sent within a period of 2 months of receipt of the request.
6. FORMATION OF THE CONTRACT BETWEEN THE TWO PARTIES
The contract between the two parties (customer and Liquides Parfums) is concluded at the time of receipt of the email confirming that the products have been shipped. To place an order on our website you must follow the steps below. Our ordering process allows you to check the information provided and correct it before confirming the order.
● Step 1: Add product to online shopping basket.
● Step 2: Click on the basket and then select ‘Order’.
● Step 3: If you do not have an account with us and would also like to join our loyalty programme, click on ‘Yes, I am interested’ in the proposal ‘Create an account and activate your loyalty card to take advantage of our loyalty programme’. Then click on ‘No account? Create one’ and enter your details. If you do have an account, identify yourself.
● Step 4: Select the delivery method.
● Step 5: Select the payment method.
Once the payment has been confirmed, you will receive an email from us confirming receipt of payment. The order is accepted when you receive an email from us stating that the order has been shipped with the tracking number and carrier used. If we are unable to provide you with a product because it is no longer in stock or has a price or description error, we will notify you by email as soon as possible to cancel your order and make a refund as soon as possible.
7. TERMS OF PAYMENT
All orders placed on the Liquides Parfums site must be paid in full when the order is placed. The following payment methods are accepted:
● Bank card
When selecting the bank card payment method, you will be redirected to the secure Crédit du Nord bank PayZen online payment gateway. This secure payment platform encrypts card details that we do not have access to. Depending on the bank, the customer may be redirected to a bank authentication page before the payment is approved. This system is called 3D Secure and allows your bank to verify the identity of the cardholder before the transaction. The authentication process to be followed is specific to each bank: you may be asked to enter your date of birth, a code received by SMS or answer a personal question. Please note that after 3 authentication failures, your card will be blocked.
We accept the following bank cards: CB, Visa, Mastercard, Electron and Maestro.
● Paypal
When you select the PayPal payment method, you will be redirected to the PayPal login page to accept payment of your customer account.
● Liquides digital gift card
Customers can pay all or part of their order with the Liquides gift card they are a beneficiary of.
8. GIFT WRAPPING AND SAMPLES
For all orders we offer samples of the perfume(s) purchased to allow you to try before opening the product sold and return it to us if it does not suit you.
To benefit from free gift wrapping, select the option at the time of ordering.
9. DELIVERY
Delivery costs and times vary depending on the delivery address and delivery method chosen and the type of product (online exclusive or not). This information is given on our website and displayed at the time of ordering. You can track your parcel at any time by entering your parcel number on the carrier's website, the coordinates of which you can find in your shipping confirmation email. In order for delivery deadlines to be met, you must ensure that you have provided full and accurate information on the delivery address (street, building, staircase numbers, access codes, names, intercom numbers, etc.). However, if we are unable to meet the estimated delivery date, we will inform you of a new date.
DELIVERY METHODS
Delivery to mainland France
● Click & Collect: free of charge
You can choose to pick up your order during business hours at the Liquides store located at 9 rue de Normandie, 75003 Paris. You will receive an email informing you that your order is ready. You will need ID to collect it.
● Paris Courier: €15
The courier service is available for all orders placed from Monday to Friday.
For same-day delivery in 3 hours, the order must be placed before 4 pm.
● Standard Delivery: €10
Standard delivery is carried out by Colissimo within 48 to 72 business hours.
Liquides Parfums offers standard delivery for orders over 75 euros for delivery to mainland France and over 200 euros for delivery to Europe.
● Express Delivery: €15
Delivery in 24 business hours for any order placed before 1 pm.
Delivery to French Overseas Departments and Territories & International
Delivery time and carrier vary depending on the destination country.
Please note that outside the European Union, customs or import taxes may be added to the price of our products and are your responsibility.
Europe (delivery within 3-8 business days): €15
French Overseas Departments and Territories (delivery within 5-10 business days): €40
Rest of the world (delivery within 5-11 business days): €40
DELAY OR FAILURE TO DELIVER
Any delivery problem or delay exceeding 7 days must be reported to our customer service department as soon as possible.
DEFECTIVE PRODUCT
We have a legal obligation to supply products that comply with the order we have accepted. If your purchase is defective or broken on arrival, we advise you to inform us as soon as possible in order to benefit from your legal consumer rights. Write to us by email at liquides@differenteslatitudes.com attaching photos of your defective product. If we agree with you following a review of the returned product, we will either offer to replace the product free of charge or refund it and the shipping costs you have paid to return it to us.
10. RIGHT TO WITHDRAW, RETURN AND REFUND
RIGHT TO WITHDRAW
In accordance with Article L.221-18 of the Consumer Code, you have the right to change your mind within 14 days of receipt of the order, according to the procedures below, without having to justify your decision.
In accordance with Article L.221-18 of the Consumer Code, the right to withdraw cannot be exercised for orders relating to the supply of products that have been unsealed after delivery and that cannot be returned for hygiene or health protection reasons.
RETURN
Following communication of the decision to withdraw, the order must be returned within 14 days. The product you wish to return must be intact, unopened and in its original packaging. Please note that you are responsible for the return costs and that no products purchased on the site may be returned to the store. Here are the steps you need to follow to cancel your order and return the product.
Step 1: Send your request for withdrawal to the email address liquides@differenteslatitudes.com specifying the order number, name and surname.
Step 2: Send the package with the prepaid transport slip provided by us. The package must contain the product in perfect condition, unused, in its original packaging and the purchase invoice.
Step 3: Refund on the same method of payment as the one used for the purchase except for gift cards, once the package is received by us and that the product is in conformity.
Please note that we will not be responsible for any loss or damage incurred during the transport of the returned product and we reserve the right not to refund you. We therefore recommend that you protect the product well and send it by registered mail and keep the proof of sending until your product is refunded.
REFUND
Refund is made within 7 business days, using the same payment method, except for gift cards and gift vouchers, which are reimbursed as credit notes. You will receive an email informing you that the refund has been made.
11. GIFT CARD AND VOUCHER
Gift cards purchased from our e-shop are valid for one year for all online products with the promotional code indicated or on presentation of the e-mail in the store. They may be combined with purchase vouchers. Gift vouchers are valid for 3 months and cannot be refunded.
12. LEGAL GUARANTEES
In accordance with the legal provisions in force, we will refund or exchange products that are defective, non-compliant or do not correspond to your order.
The products sold on our site are subject to the conditions of legal guarantee provided for under Articles L 211-4, L 211-5 and L 211-12 of the Consumer Code as well as Articles 1641 and 1648 of the Civil Code:
Article 1641 Civil Code: The seller is bound by the guarantee because of hidden defects in the thing sold which render it unfit for the purpose for which it is intended, or which impair this use so much that the buyer would not have acquired it, or would only have given a lower price for it, if he/she had known of them.
Article 1648 of the Civil Code: Any action resulting from prohibitive defects must be brought by the buyer within a period of two years from discovery of the defect. In the case provided for under Article 1642-1, the action must be brought, under penalty of foreclosure, within the year following the date on which the seller can be discharged from liability for apparent defects.
Article L211-4 of the Consumer Code: The seller is obliged to deliver goods that comply with the contract and is liable for any non-compliance existing at the time of delivery. They are also liable for any non-compliance resulting from the packaging, the assembly instructions or the installation when this is placed under its responsibility under the contract or is carried out under its responsibility.
Article L211-5 of the Consumer Code: To comply with the contract, the item of goods must:
- be specific to the usual expected use of a similar item of goods and, where applicable, correspond to: the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect in view of the public declarations made by the seller, by the producer or by its representative, in particular in advertising or labelling;
- present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, which has been brought to the knowledge of the seller and which the latter has accepted.
Article L211-12 of the Consumer Code: Actions resulting from non-compliance must be brought within two years of delivery of the item of goods.
13. LIABILITY
Différentes Latitudes may not be held responsible for any indirect damage that may occur as a result of the purchase of products, the consequences linked to use that is not in accordance with the use for which the product is intended or defects of the products and their consequences linked to any external cause. Différentes Latitudes may not be held liable for the non-performance or poor performance of contracts where this is attributable either to the consumer, or to a case of force majeure, or to the unforeseeable and insurmountable actions of a third party to the contract.
14. INTELLECTUAL PROPERTY
The Différentes Latitudes trademark, as well as all trademarks, photographs, illustrations, logos, designs and models, copyright and content appearing on the site are the exclusive property of Différentes Latitudes and/or the intellectual property rights holder concerned. Any total or partial use of trademarks, photographs, illustrations, logos, drawings and models, copyrights and content appearing on the site is strictly prohibited, except with the express, written prior consent of Différentes Latitudes and/or the intellectual property rights holder concerned, and constitutes infringement. Any hypertext link of this website or use of framing or hotlinking (in-linelinking) techniques is strictly prohibited without the express, written prior consent of Différentes Latitudes.
15. GENERAL PROVISIONS
Entire agreement
The parties acknowledge that this contract constitutes the entirety of the agreement concluded between them.
Nullity of a provision in the contract
If any of the provisions of the Terms and Conditions of Sale is cancelled, this shall not result in the nullity of the other provisions of the Terms and Conditions of Sale, which shall remain in force.
Waiver
The fact that Différentes Latitudes refrains from requiring the performance of any of the provisions of these Terms and Conditions of Sale cannot be interpreted as a waiver of the right to subsequently invoke the non-performance of the provision in question.
Modification
Différentes Latitudes reserves the right to modify these Terms and Conditions of Sale at any time by publishing a new version on the site. In the event of a modification, the applicable Terms and Conditions of Sale are the Terms and Conditions of Online Sale on the site on the date the order is confirmed.
16. APPLICABLE LAW AND DISPUTES
These terms and conditions and related sales are subject to French law. Any dispute relating to the existence, interpretation, performance or termination of the contract concluded between Différentes Latitudes and the consumer, even in the event of multiple defendants, shall, in the absence of an amicable agreement, be subject to the exclusive jurisdiction of the Paris courts.
